2. Personal data processed
Bear-art.es does not currently provide contact forms, user accounts, newsletters or its own online-payment system.
When a user contacts Bear Art Studio by WhatsApp, email or telephone, the following information may be processed:
- name and contact details;
- telephone number and WhatsApp profile information visible to the Studio;
- communication language;
- requested workshop, date, time and number of participants;
- individual needs or requests communicated by the customer;
- necessary age information relating to participants who are minors;
- payment confirmations or references;
- billing information where an invoice is requested;
- delivery address where shipment of an artwork is requested;
- the content of enquiries, incidents and complaints.
Bear Art Studio will not request personal data that is unnecessary for handling the enquiry or providing the service.
3. Purposes and legal bases
- Answer enquiries and handle booking requests: taking pre-contractual steps requested by the individual.
- Manage bookings, payments and workshops: performance of a contract.
- Issue and retain invoices and comply with tax, accounting and consumer-law obligations: compliance with legal obligations.
- Manage incidents, complaints and possible legal claims: performance of a contract, compliance with legal obligations and legitimate interests in protecting legal rights and preventing fraud.
- Arrange shipment of artwork where requested: performance of the contract or the customer’s request.
- Send marketing communications: only where valid consent or another applicable legal basis exists, with the right to object or unsubscribe.
Bear Art Studio does not carry out automated decision-making or profiling producing legal effects for users.
4. Recipients and service providers
Where necessary, personal data may be processed by or disclosed to:
- WhatsApp/Meta when that channel is used;
- website infrastructure, hosting, CDN and security providers such as Cloudflare, when active;
- banks or payment providers used to receive bank transfers or Bizum payments;
- tax, accounting or administrative advisers;
- delivery companies where the customer requests shipment;
- public authorities, courts or regulators where legally required.
Some technology providers may process data outside the European Economic Area. Where applicable, such processing must rely on an adequacy decision, European Commission-approved Standard Contractual Clauses or another valid mechanism under Chapter V GDPR.
Using WhatsApp is voluntary. Users may contact the Studio by email instead.
5. Retention
Data will be retained for as long as necessary to manage the enquiry, booking, activity, delivery or complaint. Afterwards:
- enquiries that do not result in a booking will be deleted or restricted when no longer necessary;
- booking and contractual information may be retained for the periods needed to address potential legal liabilities;
- invoices and tax records will be retained for the periods required by law;
- complaint-related information will be retained until the complaint is resolved and for the applicable limitation periods.
Personal data will not be retained indefinitely without a valid purpose.
6. Rights
Individuals may request access, correction, deletion, restriction of processing, objection, data portability where applicable, and withdrawal of consent without affecting earlier lawful processing.
Requests may be sent to magicartstudio2025@gmail.com, identifying the right being exercised. Additional identification documents will only be requested where reasonably necessary to verify identity.
A complaint may also be submitted to the Spanish Data Protection Agency.
7. Children
Bookings involving minors must be made or authorised by a parent, legal guardian or responsible adult. Bear Art Studio will process only the information about minors that is necessary to organise the activity and provide appropriate care and safety.
Promotional photographs or videos in which an individual is identifiable require separate authorisation where legally required. Participation in a workshop does not by itself authorise use of the participant’s image.
8. Security and internal access
Bear Art Studio applies reasonable measures to restrict access to information to people who need it to manage enquiries and bookings. Authorised team members may access relevant conversations. Devices and accounts used for this purpose must be protected against unauthorised access.
9. Changes
This policy may be updated when services, providers or processing activities change. The current version will remain permanently available at bear-art.es.
